A Lasting Power of Attorney is a legal arrangement that allows you to choose other individuals to manage your affairs should you become unable to do so in the future; but only during your lifetime.
Upon death, the Lasting Power of Attorney ceases, and the Will, if one has been made, takes effect. The chosen individuals are known as ‘Attorneys’, it is recommended that no fewer than two should be chosen.
Think of Lasting Power of Attorney as a form of insurance; nobody plans to lose mental capacity or become unable to manage their own affairs, but with Lasting Power of Attorney in place, you’ll have piece of mind knowing that should illness, mental capacity or an accident occur, your chosen Attorneys can manage your affairs legally.
Remember! Lasting Power of Attorney can only be arranged whilst the person has full mental capacity and is capable of understanding what the document will allow the chosen Attorneys to do on their behalf.
Firstly, the next of kin does not have legal automatic rights to manage the affairs of their husband, wife or civil partner. Only with Lasting Power of Attorney can this be achieved.
If no Lasting Power of Attorney has been arranged, and mental capacity has been lost, then a Lasting Power of Attorney can no longer be made and an application to the Court of Protection for a Deputyship Order must be made, which is significantly more expensive.
